Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you ("you," "Customer," or "User") and MythOS Systems Inc. ("Company," "we," or "us") governing your access to and use of MythOS Pro ("Service," "Product," or "App") at mythospro.ai. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

MythOS Pro is a business dashboard and communication platform that may include multi-channel messaging (email, SMS, social, etc.), AI-powered receptionist (Mylo), bookings, payments, analytics, and related features. We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Account and Eligibility

You must provide accurate account information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and have authority to bind your business (if applicable) to these Terms.

4. Acceptable Use

You agree to use the Service only in compliance with these Terms and applicable law. You will not: (a) use the Service for any illegal or unauthorized purpose; (b) attempt to gain unauthorized access to our or any third-party systems or data; (c) transmit malware, spam, or harmful content; (d) misuse or overload our infrastructure; (e) scrape or resell the Service without our written consent; or (f) use the Service in a way that infringes or violates the rights of others. We may suspend or terminate accounts that violate these terms.

5. Data and Privacy

Our collection, use, and disclosure of personal data are described in our Privacy Policy. You are responsible for ensuring that your use of the Service (including connecting third-party accounts and processing customer data) complies with applicable data protection laws (e.g., GDPR, CCPA) and that you have appropriate legal bases and notices in place for the data you provide to us.

6. Third-Party Services

The Service may integrate with third-party services (e.g., Google, Meta, Twilio, Square, Supabase). Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services or their availability, and we do not guarantee continued support for any specific integration.

7. Third-Party Trademarks and Logos

The Service may provide access to a "Logos" library containing third-party brand logos and icons. By using this feature, you acknowledge and agree to the following:

• Ownership: All third-party brand logos provided in the Logos library are the property of their respective trademark owners. We do not claim any ownership or rights in those marks.
• Nominative Use: These logos are provided solely for nominative fair use—for example, to identify a social media profile, payment method, or similar reference. You must use them in a manner consistent with applicable trademark and fair-use guidelines.
• No Endorsement: The inclusion of these logos in the Service does not imply any endorsement, affiliation, sponsorship, or approval between MythOS Systems Inc. (or the Service) and the respective trademark owners.
• Trademark Prohibitions: You are strictly prohibited from attempting to register or trademark any design created on this platform that contains a third-party logo or other trademarked element. You may not use these logos in a way that suggests endorsement or that infringes the rights of the trademark owners.

8. Third-Party Viral Media and Fair Use

The Service may include access to third-party viral media (e.g., GIFs, meme templates, and similar content) provided by external APIs and platforms. By using these features you acknowledge and agree:

• Such content is provided by third parties (e.g., GIPHY, Imgflip) and is subject to their respective terms and policies. You are responsible for complying with those terms and with applicable copyright and trademark law.
• Use of this content is permitted only for lawful, non-infringing purposes and in accordance with fair use or other applicable limitations under copyright law. You may not use third-party viral media in a way that infringes intellectual property rights, implies endorsement, or violates the rights of creators or rights holders.
• We do not endorse, control, or guarantee the accuracy or legality of third-party viral media. Your use is at your own risk, and we are not liable for any claims arising from your use of such content.

9. Intellectual Property

We own or license all rights in the Service, including software, design, and branding. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms. You retain ownership of your data; you grant us a license to use, store, and process it as necessary to provide and improve the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI FEATURES (E.G. MYLO) MAY PRODUCE INACCURACIES; YOU ARE RESPONSIBLE FOR REVIEWING OUTPUT BEFORE RELYING ON IT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTHOS SYSTEMS INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF GREATER). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED.

12. Indemnification

You agree to indemnify and hold harmless MythOS Systems Inc. and its affiliates and their officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights or law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or for any reason with notice where required by law. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnity, dispute resolution) will survive.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You waive any right to a jury trial and to participate in a class action. EU/EEA/UK consumers may retain mandatory consumer rights under their local law.

15. General

These Terms, together with the Privacy Policy and any order or policy referenced herein, constitute the entire agreement between you and MythOS Systems Inc. regarding the Service. Our failure to enforce any right or provision does not waive that right or provision. If any provision is held invalid, the remaining provisions remain in effect. We may assign these Terms; you may not without our consent.

16. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated via the Service or email. Continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.

SMS Communications & TCPA Compliance

MythOS Pro includes an AI-powered messaging service (“Mylo”) that communicates with end customers on behalf of subscribing businesses via SMS text messages. By using MythOS Pro, you acknowledge and agree to the following:

• Consent Requirement: You are solely responsible for obtaining proper consent from your customers before enabling Mylo to send them SMS messages. This includes express written consent as required by the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and any applicable state regulations.
• Opt-Out Compliance: Mylo will honor STOP/UNSUBSCRIBE requests from end customers. You must not re-add customers who have opted out without obtaining new consent.
• Message Content: You are responsible for ensuring that automated messages sent through Mylo comply with all applicable laws, including identification of the sender and opt-out instructions.
• Message Frequency: Automated outreach (reminders, re-engagement, review requests) is rate-limited. Standard message and data rates may apply to end customers.
• No Spam: You may not use Mylo to send unsolicited commercial messages, spam, or messages that violate the CAN-SPAM Act or TCPA.
• Indemnification: You agree to indemnify and hold harmless MythOS Systems Inc. from any claims, damages, or penalties arising from your failure to obtain proper consent or your misuse of the SMS messaging features.

Data Retention Policy

MythOS Pro retains different categories of data for different periods:

• Conversation Logs: Retained for 90 days from the last message in a conversation. After 90 days, messages are automatically archived. Archived data is retained for up to 1 year, then permanently deleted.
• Customer Profiles: Retained for the duration of your subscription plus 30 days after cancellation.
• Audit Logs: Retained for 1 year for compliance and debugging purposes.
• Billing Records: Retained as required by applicable tax and accounting laws (typically 7 years).
• Account Data: Upon account deletion, all personal data is purged within 30 days. Anonymized aggregate data may be retained for analytics.
• Data Export: You may request a full export of your data at any time via the dashboard or by contacting support@mythospro.ai.
